Criminal Procedure

In criminal proceedings, counsel may act either for victims—by filing complaints and seeking prosecution—or for suspects and defendants, by pursuing acquittal or the most favorable possible outcome. When representing victims, counsel must persuade the prosecutor, as the representative of the state, to bring charges; when representing suspects or defendants, counsel must advocate on equal footing with the prosecution.
